British Association of Snowsport Instructors insurance zone

Introduction

Marsh Sport are the appointed insurance broker to British Association of Snowsport Instructors (BASI). This Insurance Zone sets out details of the insurance provided as part of your membership, how to report an incident and some frequently asked questions. 

Who is covered?

The policy covers Current and Full Members of the British Association of Snowsport Instructors whilst acting within the remit of their licence.

What insurance do you get as part of your membership?

As part of your membership with BASI you automatically receive the benefit of the Combined Liability insurance. To understand what this covers and to see the main terms and conditions that apply, please make sure you refer to the policy summary and policy wording which can be found in the downloads section below.

The policies run from 1st October to 30th September annually.

The policies' limits are as follows:

  • Public Liability: £10,000,000 any one occurrence
  • Products Liability: £10,000,000 in the aggregate
  • Professional Indemnity: £5,000,000 any one occurrence and in the aggregate

Territorial Limits: Worldwide (cover in the USA is limited to temporary visits not exceeding 90 days)

Jurisdiction: Anywhere in the UK and European Union.

 

About the insurance covers

Cover for instructors if they are found to be legally responsible for causing bodily injury to third party (such as a member of the public or another member) or for damage to a third party’s property. 

Cover to protect a BASI affiliated instructor for claims made against them which allege that a third party has suffered an injury or financial loss caused by a negligent acts, errors or omissions during coaching activities that were provided in return for a fee.

Reporting an incident

It is important that all incidents that may give rise to a claim, however minor, are reported to Marsh as soon as possible after the event.

Frequently Asked Questions

BASI instructors are covered anywhere in the world.  

Public Liability and Professional Indemnity (advice, tuition & coaching cover) insurance up to the limit of indemnity stated within the Evidence of Cover letter, available in the downloads section.

Licenced members are insured in respect of instructing/coaching, whilst acting within the remit of their licence, and free skiing.

Contingent liability cover for members working in ski schools, in the event that the ski school does not have cover and the instructor is not covered by the school or another policy.

Non-licenced members are insured in respect of free skiing only.

The ‘geographical/territorial’ limits on the policy defines where you can instruct. Your liability covers are set on an anywhere in the world basis. In layman terms, this means that you can instruct, within the remit of your licence, worldwide.

The ‘jurisdiction’ is where an allegation/claim can be made against you. In layman terms, this means the country in which a solicitor can be appointed, to try and sue you, if a third party feels you are deemed negligent. The jurisdictional limit on the policy is the UK & European Union. 

The public liability cover is provided to you on an anywhere in the world basis. This would cover claims for alleged third party injury, or third party property damage.

The public liability policy does not however, provide you with any travel insurance. Travel insurance would cover overseas emergency medical treatment, following an accident, repatriation costs, cancelled flights etc.

You owe a duty of care to those around you so it is essential that you undertake risk assessments for your activities to support you in your risk management.

If an allegation for negligence is made against you the risk assessments will be needed to evidence what you have reasonably been able to do to prevent an incident occurring.

There aren’t any age restrictions on the liability insurance, however we stipulate that participation in all activities must be in accordance with the rules and guidelines of BASI. As such if there are any age restrictions imposed by BASI for certain disciplines, then these must be adhered to.

£500 excess applies to all claims in respect of Third Party Bodily Injury and Third Party Property Damage.

No, if you are injured you may wish to seek legal advice on how to pursue a claim against the person responsible for causing the injury.

Yes, the public liability insurance provided will defend your position, should you be sued for injury to a third party or damage to a third parties property. Please note any claims relating to deliberate or criminal acts are excluded.

No, the cover is only in place for those activities recognised by BASI that are within the remit of your licence.

In NO circumstances should you admit liability or agree to pay for any damage caused as this may prejudice the position of Insurers and COULD result in the withdrawal of any indemnity.

Please note this is a Liability policy where Insurers decide if negligence attaches to you, meaning any payment you make to any third parties will not necessarily be reimbursed.

Records must be kept for at least 6 years, and longer where it involves a person under the age of 18 years. Names and addresses of any possible witnesses should also be recorded. Please ensure your club has an accident book to record all such information.

In respect of safeguarding allegations records should be kept indefinitely.

There are time limits within the statute of limitations in the UK, which are typically as follows, although this can be reviewed by the court’s dependant on the circumstances. It is imperative therefore that you notify any circumstance which may give rise to a claim as soon as you are aware of it:

Personal Injury: 3 years from the date of the injury or when the person became aware of it, or if they are a child up to 3 years from their 18th birthday

Property Damage: 6 years from the date of the damage

Professional Negligence: 6 years from the date of the negligent act
