It is imperative that you do not admit liability or enter into any dialogue or written correspondence with the third party or their legal representatives. We have set out some guidance notes and procedures to assist you in the event of a liability incident.
Guidance and advice
In respect of the handling of liability claims, please note all incidents that could give rise to a claim must be immediately reported and any writ or summons you receive must be forwarded to Marsh Sport immediately.
- Any circumstance which may lead to a claim under the Countycover Plus policy should be reported to insurers as promptly as possible or within around 28 days of the incident.
- Failure to report a claim or a potential claim immediately could result in this policy not covering the incident.
- You should not admit liability under any circumstances as the insurers will respond to all allegations on your behalf.
- Please refrain from engaging in any correspondence exchanges without the insurers prior oversight and approval. Please ensure no admissions of liability or offers are made
Please note that there are strict timescales in place which must be adhered to following formal notification of a Public Liability or Employers’ Liability claim.
The Ministry of Justice stipulates an Insurer in respect of legal liability matters only has: 21 days to reply to a solicitor’s initial Letter of Claim thereafter 90 days in which to complete their investigations and come to a conclusion on liability. Failure to comply with these deadlines could result in proceedings being issued (which significantly increases the cost of a claim) or penalties becoming payable, so it is vital that notification happens as soon as possible.
If an incident occurs and someone expresses that they hold a member club, league, player or official responsible, you should only respond to the claimant that they will need to submit their intentions in writing. In the interim, the notification should be made to Marsh Sport as your broker (we in turn will notify Hiscox to ensure they are on notice and to meet policy conditions relating to claims reporting).
If you receive an intention to claim (e-mail, message etc from the claimant) or a formal letter of claim or Claim Notification Form this should be provided to Marsh Sport without delay. Hiscox will take over communications with the third party after consulting initially with you over policy cover.
By involving Hiscox early, the insurer will deal directly with the claimant on your behalf.

Claims that fall under this policy are usually notified to you either verbally or in writing by a third party or in writing from the legal representatives of a third party. In such circumstances, you should contact Marsh Sport immediately.
